COMFYARD Terms & Conditions

Last updated: 19 October 2026

1. Introduction

These Terms & Conditions apply to the use of the COMFYARD website and provide general terms relating to enquiries, quotations and services supplied by COMFYARD.

COMFYARD provides residential, commercial and strata property improvement services, including:

  • Fencing and gate installation.

  • Automatic gates and boom gate systems.

  • Decking and outdoor entertaining areas.

  • Patios and pergolas.

  • Retaining walls and structural landscaping.

  • Aluminium slat screening and composite (WPC) fencing.

  • Composite cladding and related outdoor construction services.

By using our website, you agree to use it lawfully and in accordance with these Terms & Conditions.

The terms governing a particular project will be set out in the relevant quotation, accepted proposal or written contract. Where these website terms conflict with an agreed project contract, the project contract will take precedence to the extent permitted by law.

2. Use of Our Website

You may use the COMFYARD website to learn about our services, view completed projects, submit enquiries and request quotations.

When using our website, you agree not to:

  • Use the website for unlawful purposes.

  • Submit false, misleading or fraudulent information.

  • Attempt to interfere with the website's operation, security or functionality.

  • Copy, reproduce or commercially exploit website content without permission, except where permitted by law.

We may update, modify or remove website content from time to time.

We aim to keep the website accurate and available but do not guarantee uninterrupted access or that all information will always be current or error-free.

3. Service Information

Information on our website describes the services COMFYARD may provide. The availability of a particular service, material, product, colour or installation method depends on the project, location, site conditions and supplier availability.

Photographs, illustrations, project examples and digital images are provided for general information. Actual results may vary due to site conditions, dimensions, materials, lighting and product finishes.

The final scope of work and specifications will be confirmed in the applicable quotation or contract.

4. Quotations and Pricing

Customers may request a quotation through our website, by email, by telephone or through another agreed communication channel.

Depending on the project, COMFYARD may require a site inspection, measurements, photographs, plans or additional information before preparing a quotation.

Unless otherwise stated in writing:

  • Quotations are subject to the validity period specified in the quotation.

  • Prices and GST treatment will be stated in the quotation, as applicable.

  • The quotation covers only the work, materials and allowances expressly included.

  • Items identified as exclusions, provisional sums or allowances will be dealt with according to the quotation or contract.

  • Additional work or changes may affect the price and completion date.

A website enquiry or request for a quotation does not, by itself, create a binding contract for construction work.

A project is accepted when the parties have entered into the applicable agreement and satisfied the relevant contractual requirements.

5. Acceptance of Work and Project Contracts

Before work begins, the customer should review the quotation, drawings, specifications, materials, dimensions, colours, exclusions and payment schedule.

For projects requiring a formal written contract, the relevant contract must be prepared and executed in accordance with applicable legal requirements.

Depending on the project and jurisdiction, additional documents, approvals, disclosures, insurance arrangements or cooling-off rights may apply.

These website Terms & Conditions do not replace any contract or documentation required by building legislation.

6. Deposits and Payments

Deposit requirements, progress payments and final payment arrangements will be specified in the quotation or project contract.

Customers must make payments in accordance with the agreed terms, subject to applicable law.

COMFYARD will issue invoices or other payment documentation as appropriate.

If a customer believes an invoice contains an error, they should contact us promptly so the matter can be reviewed.

Any interest, recovery costs, suspension of work or other action relating to overdue payments must be authorised by the applicable agreement and permitted by law.

No payment term in these Terms & Conditions overrides statutory restrictions on deposits or progress payments.

7. Site Access and Customer Responsibilities

Customers must arrange reasonable access to the property and work area as agreed for the project.

Unless otherwise agreed in writing, customers are responsible for:

  • Providing accurate property and project information.

  • Advising COMFYARD of known underground services, drainage, irrigation, private utilities and concealed structures.

  • Removing vehicles, furniture and personal belongings from the work area.

  • Arranging access to the property and any necessary facilities.

  • Obtaining approvals that are expressly the customer's responsibility under the contract.

  • Informing COMFYARD of relevant site hazards, restrictions or special requirements.

Where access is unavailable or the site is not ready, the project may need to be rescheduled.

Any resulting additional costs or delays will be addressed under the applicable contract and law.

8. Approvals, Boundaries and Regulatory Requirements

Projects may be subject to planning controls, building requirements, pool safety rules, easements, boundary restrictions, owners corporation or strata requirements, heritage controls and other applicable regulations.

The parties' responsibilities for obtaining permits, approvals, surveys, engineering advice and other documentation will be specified in the quotation or contract.

Customers must disclose known restrictions that may affect the proposed work.

COMFYARD will perform its contracted work in accordance with applicable legal requirements. However, customers should not assume that a quotation or website description confirms that all planning, boundary, engineering or approval requirements have been satisfied.

Where required, work may be conditional on the necessary approvals being obtained.

9. Variations and Additional Work

Changes to the agreed scope, materials, dimensions, design, colours or installation requirements may affect the contract price and timeframe.

Variations must be documented and approved in accordance with the applicable contract and legal requirements before the additional work proceeds.

The variation should identify the changed work, associated price adjustments and any effect on the schedule.

COMFYARD will not treat additional work as included in the original quotation unless this has been agreed.

10. Materials and Product Availability

COMFYARD may use timber, aluminium, steel, composite materials and other products specified for the project.

Customers should confirm material selections, colours, finishes and dimensions before approving the quotation.

Minor variations in colour, grain, texture or finish may occur between samples, batches and manufactured products.

If a specified product becomes unavailable, COMFYARD will discuss an appropriate alternative with the customer and obtain any approval required under the contract before making a material substitution.

11. Scheduling, Delays and Weather

COMFYARD will make reasonable efforts to complete work within the agreed timeframe.

Project schedules may be affected by weather, unsafe working conditions, material shortages, transport delays, unexpected site conditions, access restrictions, approval delays or other circumstances beyond our reasonable control.

If a material delay occurs, we will endeavour to notify the customer and provide an updated timeframe.

Any extension of time or other adjustment will be handled in accordance with the contract and applicable law.

12. Installation and Site Safety

COMFYARD will take reasonable steps to perform the contracted work safely and protect surrounding property.

Construction and installation activities may involve noise, dust, excavation, deliveries, temporary access restrictions and other normal site activities.

Customers must keep children, pets and unauthorised persons away from active work areas and follow reasonable safety instructions.

If an unsafe condition is identified, work may need to pause until the issue has been assessed and appropriately addressed.

13. Cancellations and Rescheduling

Customers who wish to cancel or reschedule a project should notify COMFYARD in writing as soon as possible.

The consequences of cancellation depend on the applicable contract, the stage of the work, materials ordered, work already performed and any statutory cancellation or cooling-off rights.

Any cancellation charge must be permitted by law and consistent with the applicable agreement.

Nothing in these Terms & Conditions removes a customer's statutory cancellation rights or permits COMFYARD to retain payments where doing so would be unlawful.

14. Completion, Inspection and Handover

At completion, COMFYARD may arrange an inspection or handover in accordance with the project contract.

Any outstanding items will be managed in accordance with the agreed scope, applicable contract and law.

Customers should notify COMFYARD promptly if they identify an issue with the work.

Payment, handover or use of the completed work does not automatically remove any rights the customer may have under Australian Consumer Law or applicable building legislation.

15. Defects and Warranties

Any express workmanship warranty or manufacturer warranty applicable to a project will be set out in the relevant warranty documentation, quotation or contract.

Warranty coverage and conditions may vary according to the materials, products and work supplied.

Customers who identify a potential defect should contact COMFYARD with a description of the issue, project details and supporting photographs where available.

COMFYARD will assess the issue and arrange any applicable remedy in accordance with the contract, relevant warranties and law.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee or statutory warranty that cannot lawfully be excluded.

16. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

For services, you are entitled to remedies for failures to meet applicable consumer guarantees. Depending on the circumstances and seriousness of the failure, these may include rectification, cancellation, a refund for the unused portion of the service or compensation.

Nothing in these Terms & Conditions limits any rights or remedies available under the Australian Consumer Law or other applicable legislation.

17. Website Content and Intellectual Property

Unless otherwise stated, website content, including text, graphics, photographs, logos, branding and original design material, belongs to COMFYARD or is used with permission.

You may view and use website content for personal, non-commercial purposes relating to our services.

You must not reproduce, republish, distribute or commercially exploit our content without prior permission, except where permitted by law.

You must obtain permission before using COMFYARD's name, logo or branding in a way that suggests an endorsement, partnership or other commercial relationship.

18. Third-Party Websites and Services

Our website may contain links to third-party websites or use third-party tools and services.

These services may be governed by separate terms and privacy policies. COMFYARD does not control independent third-party websites and is not responsible for their content or practices, except to the extent responsibility cannot lawfully be excluded.

Customers should review the applicable terms before using third-party services.

19. Privacy

COMFYARD may collect and use personal information to respond to enquiries, prepare quotations, arrange projects, manage contracts and improve our services.

Our handling of personal information is explained in our Privacy Policy.

By submitting personal information, you acknowledge that it will be handled in accordance with that policy and applicable privacy law.

20. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits any liability, consumer guarantee, statutory warranty or other right that cannot lawfully be excluded or limited.

To the extent permitted by law, COMFYARD is not responsible for loss or damage caused by circumstances outside our reasonable control or by matters for which COMFYARD is not responsible under the applicable contract.

Any limitation of liability applicable to a project must be lawful, appropriate to the circumstances and consistent with the agreed contract.

21. Complaints and Dispute Resolution

If you have a concern about our services or these Terms & Conditions, please contact COMFYARD through the contact details on our website.

We will endeavour to review the issue and work towards a reasonable resolution.

If a dispute cannot be resolved directly, either party may seek assistance from the relevant consumer protection authority, building regulator, dispute resolution service or tribunal, as applicable.

Nothing in this section prevents either party from exercising their legal rights.

22. Governing Law

These Terms & Conditions are subject to the laws applicable in the relevant Australian jurisdiction.

The applicable state or territory may depend on the location and nature of the project and any mandatory legal requirements.

Nothing in these Terms & Conditions excludes the operation of any mandatory law that applies to the customer or project.

23. Changes to These Terms & Conditions

COMFYARD may update these website Terms & Conditions from time to time.

The latest version will be published on this page with the updated revision date.

Changes to these website terms do not automatically amend an existing project contract. Any changes to an existing agreement must be made in accordance with that agreement and applicable law.
